Who Has a Disability?
According to the ADA Amendments Act of 2008, the Americans With Disabilities Act of 1990 and the Rehabilitation Act of 1973, Section 504 a person with a disability is anyone who:
- has a physical or mental impairment which substantially limits one or more major life activities
- has a history of such an impairment, or
- is regarded as having such an impairment.
A qualified individual with a disability is one who meets the essential functions or requirements of a program with or without reasonable accommodations.
A student who believes that he/she is eligible for services as a student with a disability must provide documentation that he/she meets the eligibility requirements as defined by the ADAAA, the ADA and the Rehabilitation Act of 1973.
